  • DISCLAIMER: By inserting an “Requested Connection Date,” the Property Owner agrees that the connection date is not guaranteed by LMUD, and that the Service Address connection date to LMUD’s Reuse Water system is subject to change at any time depending on such factors as the overall project schedule, cost, labor availability, and other factors affecting LMUD’s ability to perform this work, as LMUD may determine.

    I understand that I may request any date in the future to start service, but service addresses requiring a tap and meter be set prior to service require at least a 2 week (10-business days) advance notice of requested connection date. Connection date is not guaranteed. Charges will begin once meter has been set.

  • Customer Obligations

  • All Customers:

    Customer must pay a nonrefundable Service Fee, which is due at the time of submittal of an Application and Service Contract. In addition, once service commences, Customer must pay all rates, fees, and charges and comply with all rules and regulations of LMUD now existing or as may be revised in the future.

  • Water Customers:

    Customer shall install, at Customer’s own expense, a tap (if no tap is preexisting), a water service line commencing at LMUD’s water meter and connecting to the Customer’s home or place of use, and a cut-off valve. Customer shall be fully responsible for the service line from the water meter to Customer’s home or place of use, including the installation of an approved back-flow device if required. Tampering with LMUD’s water meter or using LMUD’s water cutoff valve is prohibited.

  • Wastewater Customers:

    Customer shall install, at Customer’s expense, a tap (if no tap is preexisting) and aback-up relief valve, and must request inspection of same by LMUD after installation.   • Customers with a grinder pump at their property are required to fill out a Grinder Pump System Service and Maintenance Addendum.
  • Important Note: If a grinder pump is present or required, LMUD will provide maintenance per the FY 2019/2020 Rate Order update.
    • For LMUD-installed grinder pumps, additional installation fees may apply.
    • For customer-installed grinder pumps, some repairs may require additional fees.
    • For all customers with a grinder pump, please call us to request a work order for maintenance to be performed
  • General Terms of Service

  • After approval of this Service Contract by LMUD, LMUD will sell and deliver water and/or wastewater to the Customer, and the Customer shall receive and pay for such service(s) in accordance with LMUD’s most current Rate Order, other orders, rules and regulations, policies, guidelines, Water Conservation Plan, and Drought Contingency Plan, as the same may be amended from time to time by LMUD in its sole discretion. As evidenced by its signature below, Customer expressly agrees to comply with and be bound by Lustrate Order, other orders, rules and regulations, policies, guidelines, Water Conservation Plan, and Drought Contingency Plan, as the same may be amended from time to time by LMUD in its sole discretion, and agrees to the imposition and payment of fines and penalties for noncompliance.

    LMUD has the authority to discontinue service to any Customer not complying with Lustrate Order, policies, rules, or regulations, or for non-payment of utility fees and other Mischarges. If service is discontinued, service will not be re-established until Customer has corrected all conditions that caused the termination. In some cases, a new Application for Service and Contract for Service must be submitted.

  • Rates, Fees, and Charges

  • LMUD’s rates, fees and charges shall be those adopted by the LMUD Board of Directors in its Rate Order, which may be revised from time to time by LMUD’s Board of Directors in its sole discretion. A brief summary LMUD’s current rates, fees and charges fees are available at LMUD’s Administrative Offices and on-line.
  • Easement

  • By the signature(s) below, the Customer(s) hereby grant(s)to LMUD any easements or rights-of-way required for the purpose of installing, inspecting, maintaining, and operating pipelines, meters, valves and any other equipment that may be required to extend or improve service by LMUD to Customer.
  • Notice of Right of Confidentiality

  • Section 182.052 of the Texas Utilities Code requires LMUD to notify customers of their right to confidentiality. You are hereby informed that you have the right to request confidentiality of your address, telephone number, social security number and any information relating to the volume or units of utility usage and the amounts billed to or collected from you for utility usage, as contained in LMUD’s records. To exercise your rights, please complete the Notification of Right of Confidentiality of Customer Information and return it to LMUD.
  • Customer Certification and Signatures

    CUSTOMER AGREES TO WAIVE, RELEASE, AND HOLD LMUD HARMLESS FROM ANY CLAIMS AND DAMAGES RESULTING FROM MALFUNCTION, FAILURE, OR ABSENCE OF CHECK VALVES, BACKFLOW PREVENTION DEVICES, AND PRESSURE RELIEF VALVES, INCLUDING WITHOUT LIMITATION, DAMAGES TO PERSONSOR PROPERTY, DIRECT DAMAGES, SPECIAL DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, OR LOSS OF PROFIT OR REVENUE.

Grinder Pump System Service and Maintenance Addendum

  • This form is required by submission from all current customers at Service Addresses with wastewater service provided by LMUD connected to the public wastewater system by use of a grinder pump system. Per the FY 2019/2020 Rate Order update, LMUD will provide service and maintenance to the grinder pump system at all eligible Service Addresses. The associated Grinder Pump Service Fee, instated on October 1, 2019, is applied to all eligible Service Addresses.

  • For all eligible customers:

    • Customer understands that as part of their wastewater fees, they will be assessed a monthly fee for grinder pump maintenance. It is the Customer’s responsibility to contact LMUD for repairs to be performed. See Rate Order for current charges.
    • Customer will not hold LMUD responsible for the payment of any invoices received by other providers hired by the Customer to perform maintenance work to the grinder pump system.
    • Customer agrees to follow the “General Guidelines for Reliable Operation of Residential Grinder Pump Systems” as stated in the LMUD Rate Order. Customer agrees to make all household residents and visitors aware of these guidelines. Failure to follow these guidelines may result in additional one-time charges.
    • Customer understands it is their responsibility to provide and maintain the electrical service and connection to the control panel associated with the grinder pump system.
    • Customer will ensure that the grinder pump tank lid remains at a minimum of 4 to 6-inches above ground level, visible and accessible at all times. The control panel must also remain visible and accessible, but the outside can be painted at Customer’s expense, if desired.

    For Service Addresses with a grinder pump system installed by LMUD:

    • Customer understands LMUD will not assess fees to repair or replace components of the system that were installed by LMUD as long as the above terms are followed.
    • Customer understands that if they hire other providers to make repairs to the system, system will be re-categorized as a “pre-existing” grinder pump system with all applicable terms (see below).

    For Service Addresses with a “pre-existing” grinder pump system (not installed by LMUD):

    • Customer understands LMUD may assess and agrees to pay additional one-time fee(s) to repair or replace pre-existing (not installed by LMUD) components of the system. Charges are not to exceed LMUD’s cost of materials for the repair or replacement. See Rate Order for details.
  • LMUD Grinder Pump Service Program Terms and Conditions

  • Trained LMUD staff will perform the maintenance and repair of eligible grinder pump systems within the LMUD service area. System components covered by this plan include: 1). all components located within the grinder pump tank, including the tank itself and 2). all components within the grinder pump electrical control panel, including the panel itself, however any electrical-related issues or repairs to the electrical service itself continue to be the property owner’s responsibility. LMUD will be responsible for scheduling routine preventative maintenance as they see fit. It is the customer’s responsibility to be aware of system malfunctions and to contact LMUD (24 hours a day, 7 days a week) for repairs; neglect may result in additional one-time charges.

    All system components outside of the aforementioned components, including, but not limited to, the service line(s) connecting to and from these system components are the responsibility of the property owner and must be repaired or replaced in a manner and with parts that follow all regulatory plumbing codes within the confines of the original location in order to prevent system malfunction (for system design changes, please contact LMUD to schedule a Site Assessment). A Plumbing Permit must be submitted prior to repair work and work must be completed by a technician with a valid Texas license. Failure to follow these guidelines may result in additional one-time charges.

  • Additional Terms and Conditions

  • In addition to the above, the following terms and conditions apply for LMUD to perform service and maintenance to the grinder pump system at the Service Address. Please review this information carefully:

    • Customer grants LMUD permission to access Service Address:
      • Customer grants LMUD staff unrestricted access to all exterior components of the grinder pump system at the Service Address, with or without prior notice, to perform routine maintenance and/or repairs as they deem necessary.
      • Property Owner understands that any property damage proven to be the result of these visits will be repaired at the expense of LMUD. Formal complaints must be presented in writing to the General Manager.
    • Notice of Additional Required Documents and Fees:
      • A new Application and Service Contract must be submitted for the Service Address stating the request for water and wastewater services. All applicable fees and charges must be paid in full prior to initiating service.
      • Once the Service Address has been connected to wastewater, the current customer for the LMUD account file associated with the Service Address will be responsible for paying all future charges, which will appear on their regular utility bills from LMUD.   
      • Other circumstances, including new construction, may require additional contracts and fees.

  • By my/our initials below, I/we affirm that a Contract for Installation for the ODWW Project was previously executed for this Service Address on the date listed below ("Original Contract"). By submitting this Contract for Installation, Property Owner agrees that on LMUD's execution of this Contract for Installation, any payments of Nonrefundable One-Time Charges under the Original Contract will be transferred to this Contract for Installation and the Original Contract will be terminated and replaced with this Contract for Installation.

    LMUD’s ODWW Project is being constructed in two phases, which will also affect connection timing. The two phases are:

    • within the boundaries of Phase 1 of the ODWW Project (“Phase 1”) or
    • within boundaries of Phase 2 of the ODWW Project (“Phase 2”)

  • I /We agree to allow LMUD to install the grinder pump system needed to connect our Service Address to LMUD’s public wastewater system when LMUD’s project schedule allows (at LMUD’s sole determination), at no additional cost to me/us if it falls within LMUD’s standard assessment of work, and agree to the following additional provisions:

    • I/We will hire, at my/our expense, a qualified electrician, licensed in the state of Texas, to install, at LMUD’s specified location, and run electrical for the control panel, provided by LMUD, before LMUD’s completion of the grinder pump system install.
  • I/We agree to install by a qualified plumber and an electrician, licensed in the state of Texas, meeting LMUD’s technical and location specifications, the grinder pump system needed to connect our Service Address to LMUD’s public wastewater system and agree to the following additional provisions:

    • I/we understand that LMUD will provide, at no additional cost to me/us if it falls within LMUD’s standard assessment of work, all contents of the grinder pump tank and control panel. All other materials will be sourced and purchased at my/our sole expense and meet LMUD’s technical specifications.
    • I/we agree that I/we will wait for LMUD to extend the wastewater line and/or set our tap before beginning the grinder pump system install. I/we will contact LMUD for the periodic inspections as specified by LMUD during the install process. A final inspection, scheduled by LMUD, signifies the approval to operate the grinder pump system. Additional fees may apply if any of the inspections fail.

  • Additional Terms and Conditions:

  • The following additional terms and conditions apply to all connection requests as part of the ODWW Project.

    • Property Owner Requesting a Regular Connection:
      • Pay a Wastewater Tap Fee.
      • Do not have to pay the Non-Refundable One-Time Charges.
      • Are responsible for hiring, at their expense, a qualified electrician, licensed in the state of Texas, to install, at LMUD’s specified location, and run electrical for, the control panel, provided by LMUD, before LMUD’s completion of the grinder pump system install.
      • Understand any provided anticipated connection date is not guaranteed and subject to change at any time depending on such factors as the overall project schedule, cost, labor availability, and other factors affecting LMUD’s ability to perform this work, as LMUD may determine.
    • Property Owner Requesting an Early Connection:
      • Do not have to pay a Wastewater Tap Fee.
      • Pay the Non-Refundable One-Time Charges.
    • Property Owner selecting a Late Connection:
      • Do not have to pay a Wastewater Tap Fee.
      • Pay the Non-Refundable One-Time Charges.
    • Property Owner Declining Connection:
      • Do not have to pay the Wastewater Tap Fee or Non-Refundable One-Time Charges.
      • May change their minds and request a connection by submitting a new Contract for Installation with the selection of a Late Connection option (Early Connection and Regular Connection options are not available at a Service Address with a current or previous Owner who declined a Regular Connection).
    • All Property Owners who Request to Connect:
      • Are responsible for the proper maintenance of the grinder pump system at the Service Address at their own expense and must follow the maintenance guidelines outlined in LMUD’s Rate Order or at www.LakewayMUD.org.
      • At the Property Owner’s request, LMUD will perform repair service on the installed grinder pump system. Additional fees may apply. Routine maintenance will also be performed by LMUD. See LMUD Rate Order for details.
      • Property Owners are solely responsible for paying the electric charges associated with the operation of the grinder pump system at the Service Address.
      • Agree to review the Site Assessment within three (3) business days of presentment by LMUD and abide by all terms and conditions within the signed, final version of the Assessment.
    • All Property Owners who Request to Connect with Existing Septic Tank(s):
      • As part of the ODWW Project, LMUD or Property Owner will be responsible for decommissioning the existing septic tank at a connected Service Address following Texas Administrative Code, Title 30, Part 1, Chapter 285, Subchapter D, RULE §285.36. LMUD will file all required paperwork with LCRA and TCEQ. All paperwork will be stored in LMUD’s account file associated with the Service Address. Decommissioning the septic tank takes it out of service; the tank will not be removed.
    • Notice of Additional Required Documents and Fees:
      • Property Owners requesting to connect to LMUD’s public wastewater system must also submit a new Application and Service Contract for the Service Address stating the request for water and wastewater services. All applicable fees and charges must be paid in full prior to initiating service.
      • Once the Service Address has been connected to the LMUD Public Wastewater System, the current customer for the LMUD account associated with the Service Address will be responsible for paying all charges, which will appear on their regular utility bills from LMUD.

  • Customer Obligations

  • All Customers:

    Customer must pay a nonrefundable Service Fee, which is due at the time of submittal of an Application and Service Contract. In addition, once service commences, Customer must pay all rates, fees, and charges and comply with all rules and regulations of LMUD now existing or as may be revised in the future.

  • Water Customers:

    Customer shall install, at Customer’s own expense, a tap (if no tap is preexisting), a water service line commencing at LMUD’s water meter and connecting to the Customer’s home or place of use, and a cut-off valve. Customer shall be fully responsible for the service line from the water meter to Customer’s home or place of use, including the installation of an approved back-flow device if required. Tampering with LMUD’s water meter or using LMUD’s water cutoff valve is prohibited.

  • Wastewater Customers:

    Customer shall install, at Customer’s expense, a tap (if no tap is preexisting) and aback-up relief valve, and must request inspection of same by LMUD after installation.   • Customers with a grinder pump at their property are required to fill out a Grinder Pump System Service and Maintenance Addendum.
  • Important Note: If a grinder pump is present or required, LMUD will provide maintenance per the FY 2019/2020 Rate Order update.
    • For LMUD-installed grinder pumps, additional installation fees may apply.
    • For customer-installed grinder pumps, some repairs may require additional fees.
    • For all customers with a grinder pump, please call us to request a work order for maintenance to be performed
  • General Terms of Service

  • After approval of this Service Contract by LMUD, LMUD will sell and deliver water and/or wastewater to the Customer, and the Customer shall receive and pay for such service(s) in accordance with LMUD’s most current Rate Order, other orders, rules and regulations, policies, guidelines, Water Conservation Plan, and Drought Contingency Plan, as the same may be amended from time to time by LMUD in its sole discretion. As evidenced by its signature below, Customer expressly agrees to comply with and be bound by Lustrate Order, other orders, rules and regulations, policies, guidelines, Water Conservation Plan, and Drought Contingency Plan, as the same may be amended from time to time by LMUD in its sole discretion, and agrees to the imposition and payment of fines and penalties for noncompliance.

    LMUD has the authority to discontinue service to any Customer not complying with Lustrate Order, policies, rules, or regulations, or for non-payment of utility fees and other Mischarges. If service is discontinued, service will not be re-established until Customer has corrected all conditions that caused the termination. In some cases, a new Application for Service and Contract for Service must be submitted.

  • Rates, Fees, and Charges

  • LMUD’s rates, fees and charges shall be those adopted by the LMUD Board of Directors in its Rate Order, which may be revised from time to time by LMUD’s Board of Directors in its sole discretion. A brief summary LMUD’s current rates, fees and charges fees are available at LMUD’s Administrative Offices and on-line.
  • Easement

  • By the signature(s) below, the Customer(s) hereby grant(s)to LMUD any easements or rights-of-way required for the purpose of installing, inspecting, maintaining, and operating pipelines, meters, valves and any other equipment that may be required to extend or improve service by LMUD to Customer.
  • Notice of Right of Confidentiality

  • Section 182.052 of the Texas Utilities Code requires LMUD to notify customers of their right to confidentiality.
