Invitation for Bids: HIGHLANDS 1.0 MG ELEVATED STORAGE TANK

INVITATION FOR BIDS (IFB)

The LAKEWAY MUD (OWNER) requests and will receive sealed BIDS for the HIGHLANDS 1.0 MG ELEVATED STORAGE TANK (E-6) Project until 10:00 AM local time on Tuesday, July 1, 2025 at 1097 Lohmans Crossing, Lakeway, Texas 78734.  The BIDS shall be sealed and addressed to:

Highlands 1.0 MG Elevated Storage Tank (E-6) Project

The BIDS will be publicly opened and read aloud at the above address at 10:00 AM local time. BIDS received after the closing time will be returned. The Work consists of the following:

Construction of a new 1.0 million gallon (MG) elevated storage tank approximately 200-ft tall to provide a hydraulic grade line elevation of 1305 ft MSL, as indicated on the Drawings. Complete Civil, Structural, Mechanical, Plumbing, and Electrical work are included as part of the Work. Site utilities and other related site improvements are also included.

Physical Bidding Documents may be examined at Lakeway MUD office, 1097 Lohmans Crossing, Lakeway, Texas 78734, phone number 512-261-6222. Requests for electronic Bidding Documents for the Project can be obtained from the Owner only as described below. Requests for Bidding Documents shall be made via email only to the Owner’s project representative:  Christianne Castleberry at cc**********@********ud.org.

The Owner will maintain a list of registered Bidding Documents holders and other information relevant to submitting a Bid for the Project. All official notifications, Addenda, and other Bidding Documents will be communicated to only registered Bidding Documents holders via email by the Owner’s project representative. Neither Owner nor Engineer will be responsible for Bidding Documents, including Addenda, if any, obtained from sources other than the Owner.

Applicable to Alternate Bid Item No. 1 (ALT1), entire paragraph:  Any contract(s) awarded under this Invitation for Bids are subject to the American Iron and Steel (AIS) requirements of federal law, including federal appropriation acts and Section 1452(a)(4) of the Safe Drinking Water Act (42 U.S.C. §300j-12(a)(4)), as applicable, and may be contingent upon release of funds from the Texas Water Development Board (TWDB).  Contract(s) awarded under this IFB are expected to be funded in part by financial assistance from TWDB. Neither the U.S. Environmental Protection Agency (EPA) or the State of Texas, nor any of its departments, agencies, or employees are or will be a party to this IFB or any resulting contract. Bidders on this work will be required to comply with the Department of Labor regulations at 41 CFR Part 60-4, relating to Construction Contractors—Affirmative Action Requirements, which include the President’s Executive Order No. 11246, as amended by Executive Order 11375 and Executive Order No. 13672, in the award and administration of contracts awarded under TWDB financial assistance agreements. Failure by the Contractor to carry out these requirements is a material breach, which may result in the termination of the awarded financial assistance. Affirmative Action requirements, requiring no discrimination on the basis of race, color, national origin, or sex (40 CFR Part 7) applies. Davis-Bacon prevailing wage requirements apply to the construction, alteration or repair of treatment works carried out, in whole or in part, with assistance made available by the Drinking Water State Revolving Fund Program (DWSRF), per TWDB Guidance No. DB-0156.

Bid Security in the amount not less than five percent (5%) of the total amount of the BID, issued by an acceptable surety company, must accompany each BID as a guarantee that the Successful Bidder will enter into contract and execute Bonds and Guaranties on the forms provided within ten (10) days after the date Contract Documents are received by the CONTRACTOR.  Bid Security shall be in accordance with the Instructions to Bidders.

LAKEWAY MUD reserves the right to reject any or all BIDS or to waive any informality in the bidding process.  In case of ambiguity or lack of clearness in stating the prices in any BID, the OWNER reserves the right to determine which BIDS are the lowest and/or best, and to award the contract on this basis.  No BID may be withdrawn within forty-five (45) days after opening of BIDS. If a submitted BID is withdrawn within the said period, BID guarantee shall become property of the OWNER, not as penalty, but as liquidated damages, and OWNER may pursue other action allowed by law. The successful BIDDER must furnish a “PERFORMANCE BOND” and “PAYMENT BOND” on forms provided with the Contract Documents.  Each bond shall be issued in an amount of one hundred percent (100%) of the Contract amount from a solvent Surety company, authorized to do business in the State of Texas and acceptable to the OWNER.

Engineer’s estimate for the Project is $ 9,193,963.  Contract Time is of the essence and all Work shall be substantially completed within 520 Calendar Days after the Notice to Proceed, and complete and ready for final payment within 550 days, in accordance with the Agreement. 

BIDS may be held by the LAKEWAY MUD for a period not to exceed forty-five (45) days from the date of the bid opening for the purpose of reviewing the BIDS and investigating the BIDDERS’ qualifications prior to the contract award.

General Contractors are invited to attend a mandatory pre-bid conference for this project.  The pre-bid conference will be held on Wednesday June 18, 2025, at 10 AM local time at the LMUD District Office located at 1097 Lohmans Crossing, Lakeway, TX 78734. The purpose of the Pre-Bid Conference is to familiarize Bidders with the requirements of the Project and the intent of the Contract Documents, and to receive comments and information from interested Bidders.  After the meeting is adjourned, interested parties will be permitted to visit the Project site, accessible per the existing access roadway located south of 109 Baldovino Skyway, Lakeway, Texas 78738.
